These Terms and Conditions ("Terms") govern your use of Hart Group's website, membership programme, savings plan, and affiliate income scheme. By accessing our website or registering as a member, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Acceptance of Terms

By creating a Hart Group account, enrolling in the Savings Plan, or participating in the Affiliate Programme, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines we may publish from time to time.

We reserve the right to modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

Eligibility

To register as a Hart Group member, you must:

• Be at least 18 years of age
• Be a resident of India with a valid address proof
• Possess a valid government-issued photo ID (Aadhaar, PAN, Voter ID, or Passport)
• Have an active Indian bank account for receiving payouts
• Provide accurate, complete, and up-to-date information during registration

Hart Group reserves the right to reject any application at its sole discretion without assigning a reason.

Account Registration & KYC

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your login details with any other person. Any activity carried out under your account will be your sole responsibility.

KYC (Know Your Customer) verification is mandatory for:

• Enrolling in the Savings Plan
• Participating in the Affiliate Programme
• Receiving any payout or commission
• Redeeming maturity benefits

Savings Plan Terms

The Hart Group Savings Plan operates under the following terms:

• The minimum monthly contribution is ₹1,000 (One Thousand Rupees)
• The savings period is 12 consecutive months from the date of enrolment
• A 50% maturity benefit is awarded only if all 12 monthly payments are made on or before the due date, with no missed or late payments
• Missing even one instalment disqualifies the member from receiving the 50% maturity benefit
• Savings can be redeemed only against Hart Group products; cash withdrawal is not permitted
• The plan is non-transferable and cannot be gifted to another individual
• Hart Group reserves the right to modify scheme terms with 30 days' prior notice to enrolled members

Affiliate Programme Terms

Participation in the Affiliate Programme is subject to the following conditions:

• You must maintain at least one active direct referral to qualify for commissions at any level
• Commissions are calculated on the 1st of each month based on active referral payments received
• A deduction of 5% TDS and 5% Admin charges will be applied on all commission payouts
• Commissions are credited to your registered bank account between the 1st and 10th of each month
• Self-referral or creation of fake accounts to generate commissions is strictly prohibited
• Commission rates are subject to change with 30 days' prior notice
• Hart Group does not guarantee any specific income level from the Affiliate Programme

Payments & Payouts

All payments to Hart Group must be made through authorised payment channels as specified on our platform. Cash payments are not accepted.

• All prices and plan amounts are denominated in Indian Rupees (INR)
• Payments once made are non-refundable except as described in our Refund & Return Policy
• Payout requests are processed subject to successful KYC verification
• Minimum payout threshold and processing timelines will be communicated within the member portal
• Hart Group is not responsible for delays caused by banking partners or third-party payment processors

Products & Delivery

All products offered by Hart Group are subject to availability. We reserve the right to modify product specifications, pricing, and availability without prior notice.

• Delivery timelines are indicative and may vary based on location and product availability
• Risk of loss or damage passes to the customer upon delivery
• All products are covered by the manufacturer's standard warranty
• Product images on the website are for illustrative purposes and may slightly differ from the actual product

Prohibited Activities

You agree not to engage in any of the following:

• Creating multiple accounts or fictitious accounts for personal gain
• Using automated tools or bots to interact with our platform
• Making false or misleading representations about Hart Group's products or programmes
• Engaging in any activity that could damage, disable, or impair our systems
• Attempting to gain unauthorised access to other members' accounts
• Using Hart Group's brand, logo, or materials without written permission
• Promoting Hart Group in a manner inconsistent with our guidelines

Termination

Hart Group reserves the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that is harmful to other members or the company.

Upon termination:

• Access to your account and all associated benefits will be revoked
• Pending commissions may be forfeited if termination is due to a breach of these Terms
• Any active savings plan instalments already paid will be handled as per the Refund & Return Policy

Limitation of Liability

To the fullest extent permitted by applicable law, Hart Group shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of income, data, or business opportunities.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the total amount paid by you to Hart Group in the 12 months preceding the claim.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Davanagere, Karnataka, India.

We encourage you to first contact us to resolve any dispute amicably before initiating legal proceedings.
